1) Terms of Use

By accessing or using this website (the “Site”), you agree to these Terms and the policies below. If you do not agree, do not use the Site.

• No legal/tax advice. Site content is general information, not legal, tax, or financial advice.
• Acceptable use. Do not misuse the Site (no unauthorized access, malware, scraping without consent, or interference).
• Intellectual property. The Site and its content are owned by us or our licensors. You receive a limited, revocable license to use the Site for your personal or business purposes related to a transaction with us.
• Third-party services. Some features may integrate third-party tools (forms, e-signature, analytics, maps). Their terms and privacy notices apply.
• Disclaimer. THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
• Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability related to your use of the Site will not exceed $100.
• Indemnity. You agree to defend and hold us harmless from claims arising out of your use of the Site or breach of these Terms.
• Governing law / venue. Florida law applies; exclusive venue is in the state or federal courts in Leon County, Florida.

2) Privacy (Summary)

We collect and use information to respond to quote requests, open and service title/escrow orders, prevent fraud, comply with law, and operate the Site.

• What we collect. Names, contact details, property/transaction info, parties (buyers/sellers/agents/lenders), limited financial details (e.g., loan amount, purchase price), files you upload (e.g., contracts), and basic usage/analytics data.
• Sources. You; your representatives (agents/lenders); public records; service providers; lawful automated collection (cookies/analytics).
• Use & sharing. To process quotes and orders; with underwriters, lenders, notaries, couriers/recorders, e-signature/closing platforms, IT/security providers, and regulators or law enforcement as permitted or required by law. We do not sell personal information.
• Security & retention. We apply reasonable safeguards and keep records consistent with legal/operational requirements, then securely dispose of them.
• Your choices. Update your contact info or request access/correction where applicable by emailing admin@berbicetitle.com. Our services are intended for adults; we do not knowingly collect data from children under 13.

3) Cookies

We may use strictly-necessary, functional, and analytics cookies to operate and improve the Site. You can control cookies via your browser settings. Disabling some cookies may affect functionality.

4) SMS & Email Consent

By providing your phone number and/or email, you agree we may contact you about quotes, orders, and closings. Texts may use automated technology. Message/data rates may apply. Frequency varies. Consent is not a condition of purchase. To opt out of texts, reply STOP. For help, reply HELP or email admin@berbicetitle.com.

5) E-Sign & Electronic Records

By proceeding online (including e-signature or Remote Online Notarization where available), you consent to receive and sign records electronically. You may request paper copies or withdraw consent by emailing admin@berbicetitle.com (withdrawal may delay services). You’ll need a compatible device, current browser, and internet access.

6) Accessibility

We aim for conformance with WCAG 2.1 AA and continuous improvement. If you encounter accessibility barriers, contact us at admin@berbicetitle.com or (407) 467-7278 and describe the issue and assistive technology used; we’ll work to provide the content you need.

7) Wire-Fraud Warning

Real-estate transactions are a target for wire fraud. We will never change wiring instructions by email. Always verify wiring instructions by calling us at a known number before sending funds. Do not rely solely on emailed instructions. If anything seems suspicious, stop and call (407) 467-7278 immediately.

8) Refunds, Cancellations & Fee Disclosures

• Quotes. Estimates are informational and may change based on final details.
• Services performed. Fees for work already performed (e.g., title search/exam, notary/RON, courier/recording) are not refundable.
• Order cancellations. You may be responsible for costs incurred up to cancellation.
• Escrow deposits. Release of funds requires required party authorizations and/or a final order, consistent with law and contract terms.
